Medical Records are the KEY TO YOUR CASE!
Dear Harlan:
Having been a registered nurse for over 20 years and a former owner of a surgery center, I know medical records. Having been a certified Legal Nurse Consultant for over 10 years and a business owner in the same industry, I know how important those records are in a legal case, especially in today’s world.
With the current state of our economy, it is clear that our society will become increasingly litigious in attempt to attain alternative sources of income. Despite public perception that this might not be possible, most companies in the industry of litigation get busier during economic hardships. Individuals will pursue medical malpractice and personal injury claims they might not have previously, and companies will defend these claims ever more emphatically.
Medical records are the key to both pursing and defending these claims. With the increasing volume of claims, attorneys need to be equipped with all of the critical medical details: strengths and weaknesses alike.
Look how the medical records were the key to the Vioxx cases. This will be the new standard for Mass Tort claims. Companies have taken to the strategy of defending each claim and are less apt to settle without some level of review of the records.
An additional risk of putting off record review is that of letting their clients believe they have a stronger case than they do. Attorneys are finding themselves trapped by their own premature assurances, which can only result in delayed disappointment or worse.
Attorneys need to know what their cases hold in advance so they can approach each one appropriately -- or run the risk of an unsatisfactory result, or even worse, getting caught in a position of malpractice.
All the best ,
Nancy
